This privacy policy ("Privacy Policy") describes how KATALYST collects and uses the personal information you provide to us through our website, KATALYSTOS.com ("Website") and any mobile application or other application or service connected or associated with the Website (collectively, "Sites"). It also describes the choices available to you regarding our use of your personal information and how you can access and update this information.

Third parties, such as restaurants at which you make reservations, place orders and to which you make payments through the Sites may also collect and use information provided by you. Additionally, social networks used in connection with the Sites or external websites to which we link may collect and use information provided by you through the Sites. This Privacy Policy does not address the activities of third parties – please consult with them directly.

KATALYSTmay, in its sole discretion, amend this Privacy Policy at any time and from time to time without notice. Any material changes to our policy will be reflected herein. By continuing to use any of the Sites, you agree to and accept the terms and conditions of our Privacy Policy as so amended.

How We Collect Your Information

We receive a number of different types of information about you. For example, we may receive your name, e-mail address, birthdate, postal address, phone numbers, billing information, survey responses, demographics, primary dining city, current and prior restaurant reservation details, favorite restaurants, special restaurant requests, seating preferences, prior third party purchases, passwords, contact information of people you add to, or notify of, your restaurant reservations through our Sites, and other information you provide on our Sites. Some information may be provided by you and we may obtain information about you through third party websites or services. We also may gather certain information about you through your use of the Sites. Our Sites do not respond to 'Do Not Track' (DNT) signals.  

Registration information
When you sign up for KATALYST through our Sites, you are required to provide information such as your name, email address, and gender. In some cases, you may be able to register through third party services such as Facebook.  

Payment card information
For certain services on our Sites, such as to make reservations at certain restaurants; to make payments to certain restaurants; and to purchase gift cards, or other products or services, you may be required to provide credit or debit card account information.  

Additional information you may choose to share
Information that you choose to post on third party sites or social networks, such as Facebook, may be shared with us. Such information includes your profile information, as well as your friends list. It also may include the information you choose to share when you take an action, such as when you invite others to join KATALYST. Your name, profile pictures, cover photos, gender, networks, username and User ID may be treated as public information.  

Other information and data we receive about you
We receive data about you whenever you sign in with Facebook and when you share your information to Facebook through KATALYST.
We receive data from the computer, mobile phone or other device you use to access KATALYST. This may include your IP address, mobile device ID and other information about things like your Internet service, location, the type (including identifiers) of browser you use, or the pages you visit. For example, we may receive your GPS or other location information so we can tell you the proximity of eating establishments. When we receive your GPS location, we may combine it with other location information we have about you (such as your current city), but we not maintain it once it is no longer useful to provide services to you.
We sometimes receive data through cookies and similar technology, which are small data files that may have unique identifiers and reside, among other places, on your computer or mobile device, in e-mails we send to you, and on our web pages.
We may access information contained in cookies placed on your device by a third party as permitted by the terms of your agreement and privacy settings with such third party. This information may include the date and time you visit a site; the web address, or URL, used; technical information about the IP address, browser and the operating system you use; and, if you are logged in to Facebook, your Facebook User ID.We may conduct user surveys on our Sites to provide us with information, such as user identity and user viewing habits and to determine whether or not users found what they were searching for, and/or whether the Site content remains relevant to user needs.  

Public information
Our Sites may collect public information such as the addresses provided by the USPS for certain locations and report, upon your approval, your location at the time you use the check-in feature.

How We Use Your Information
We use the information we receive about you in connection with the services and features we provide to you through the Sites. For example, in addition to helping you find relevant information about bars and restaurants nearby, we may use your information:to make and change your restaurant reservations made through our Sites;to offer you, or provide you with, products and services [and the option to pay your bill at a restaurant through our Sites];to respond to your inquiries and comments and provide customer service;to improve the quality of our Sites and personalize your experience;to understand your preferences and to enhance, personalize, and customize your experience with our Sites, products, and services;to make recommendations about other restaurants you may like;to keep KATALYST and other KATALYST products, services and applications safe and secure;to authenticate your credit or debit card account information;to protect our or others' rights or property;to protect against, investigate, and deter fraudulent, unauthorized, or illegal activity;to provide you with location features and services, such as telling you when something is happening nearby;to make suggestions to you and other users on KATALYST, such as suggesting that your friend use our contact importer because you found friends using it, suggesting that another user add you as a friend because the user imported the same email address as you did, or suggesting that your friend tag you;for internal operations, including troubleshooting, data analysis, testing, research and service improvement; andto communicate offers, promotions, upcoming events and new products and services.Granting us the permission to use your information allows us to provide services to you through the KATALYST platform as it exists today and to develop and provide new and innovative content, features and services in the future.Your information is always yours – you own it. By using our Sites, you are giving us permission to use the information that we receive about you in accordance with this Privacy Policy. We do not share information we receive about you with others unless we have:received your permission;given you notice, such as by telling you about it in this Privacy Policy; orensured that the information provided is anonymized and contains no personally-identifiable information.Please note that information that you provide to others and that is shared with us is subject to the privacy policy of such third parties. Such third parties control how that information is shared.We store data for as long as it is necessary to provide products and services to you and others, including those described above. Typically, information associated with your account will be kept until your account is deleted, subject to certain specific data retention practices we may communicate to you.When and With Whom We May Share Your InformationWe will not sell, share, license or lease your information to third parties other than businesses that are affiliated with KATALYST ('Affiliates') without your consent, except as noted in this Privacy Policy.

Information shared with restaurants
When you make a restaurant reservation through our Sites, your information is provided to us and to the restaurants with whom you choose to make a reservation. To facilitate your reservation, your information is provided to that restaurant, just as it would be if you made a reservation by contacting the restaurant directly. If you provide a mobile phone number, restaurants may send you text messages regarding your reservation. Some restaurants may require that you provide credit or debit card account information to secure your reservation. When you make a restaurant reservation through our Sites and/or make a payment to a restaurant through our Sites, we may also share additional information with the restaurants, such as information about your dining preferences, prior purchases and history or information that we collect from third parties. You also have the option of indicating special preferences or providing comments about your reservation that KATALYST will pass on to that restaurant.We may share with restaurants summary reports of feedback from diners. If you provide comments about a restaurant through our Sites, those comments may be shared with the restaurant. We will not provide any information about your identity with your comments, but a restaurant may be able to determine your identity / the source of the comments; especially if you give your name in the comments or provide contact information.Information you choose to share with a restaurant when you make a reservation and/or pay a restaurant through our Sites may be used by the restaurant for its own purposes. KATALYST does not control, and is not responsible for, the privacy practices of restaurants. Please contact the restaurant directly if you want to learn about its privacy practices.

Information shared with other vendors
If you purchase a gift card or other merchandise offered by a restaurant or other vendor through our Sites, we notify the applicable vendor and provide it with certain related information about your purchase, including your name, e-mail address, the amount of the gift card and the product or service purchased.

Sharing of payment card information
By submitting your credit or debit card account information through our Sites, you expressly consent to the sharing of your information with restaurants, third-party payment processors and other third-party service providers (including but not limited to vendors who provide fraud detection services to us and other third parties).When you use a credit or debit card to secure a reservation through our Sites, we provide your credit or debit card account information (including card number and expiration date, but excluding the CVV number) to our third-party payment service providers and the applicable restaurant.If you choose to use our restaurant payment services, when you initially provide your credit or debit card account information through our Sites, we provide your credit or debit card account information to our third party payment service providers. These third parties may store your credit or debit card account information so you can use our restaurant payment services through our Sites in the future.If you purchase gift cards or other merchandise or services through our Sites, we collect the credit or debit card account information from you. We share this information with our third party payment service providers in order to process your payments. These third parties may store your credit or debit card information, other than your CVV number, for your future use on our Sites. Your CVV number will not be stored and must be re-entered for each order.

Other parties with whom we may share your information
We may share content that you provide, such as feedback and opinions, and we may share other information provided by you or obtained through the use of the Sites (including but not limited to, information from cookies, log files, device identifiers, location data, and usage data) with Affiliates. Affiliates may use this information to help analyze and improve the Sites (including by providing analytics) and to improve or supplement the Affiliates' own services (including by providing you with better and more relevant experiences). Such Affiliates will be required to honor the choices you make about who can see your information.We may share your information and location data with third party organizations that help us provide our services to you ('Service Providers'). To change your privacy settings, please change your profile setting. Once you have shared information or made it public, that information may be re-shared by others.Our Sites may allow you to connect and share your actions, comments, content, and information with friends or with the public. Our Sites may also allow you to connect with us and others on third party platforms, such Facebook.If you remove information that you posted to our service, copies may remain viewable in cached and archived pages, or if other users have copied or saved that information.

What happens in the event of a change of control of KATALYST:
If we sell or otherwise transfer part or all of KATALYST or our assets to another organization (e.g., in the course of a transaction such as a merger, sale, acquisition, dissolution, or liquidation), the information we have collected about you, including your name and e-mail address, your user information and any other information collected by us may be among the items sold or transferred. You and the recipient of your information as a result of such a transfer will continue to be subject to this Privacy Policy, as it may be amended.

Responding to legal requests and preventing harm:
We may access, preserve and share your information in response to a legal request (such as a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. Although our agreements with third parties that receive your credit or debit card account information require them to keep it secure and confidential, we cannot guarantee that transmissions of your credit or debit card account information or personal information will always be secure or that unauthorized third parties will not ever be able to defeat the security measures taken by KATALYST or our third party service providers.

We assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorized third party access, or other causes beyond our control.The safety and security of your information also depends on you. You play an important role in keeping your personal information secure. You should not share your user name, password, or other security information for your KATALYST account with anyone. If we receive instructions using your user name and password, we will consider that you have authorized the instructions.How to Access and Update Your InformationYou may update your account at any time by logging in and changing your profile settings.You may unsubscribe from email communications from us by clicking on the 'unsubscribe link' provided in such communications.
